I. Application of the general sales conditions
The present conditions govern exclusively mail order sales of alcoholic beverages, spirits and accessory products by Viré Wine Cellars. Unless specifically stipulated in the present conditions and agreed in writing by the parties, namely in Viré Wine Cllars' commercial offers, orders are subject by right to the present general sales conditions, whatever the clauses, moreover, which may figure on the documents completed by the buyer.
II. Buying
Viré Wine Cellars can refuse the right to benefit from the advantages of its offers to any person or artificial person who proves to be or to represent a professional retailer. Viré Wine Cellars reserve the right to cancel or refuse any order from a customer with whom there exists a disagreement concerning a previous order. the offers are valid until the date mentioned and while stocks last. The quantities proposed by default in the order cart may be modified. However, to avoid the risk of breakage during transport, we recommend that you order these products by 12 bottles or multiples thereof.
Confirmation of your order by telephone may be requested for each new customer.
All orders are accepted subject to the corresponding payment being received.

III. Pricing
Our prices are given inclusive of tax in our commercial offers and are valid within Metropolitan France.
They apply within the period of validity mentioned in our commercial offers or estimates. The products are invoiced on the basis of the price current when the order is recorded.
IV. Conditions of payment
Products may be paid for by cheque or bank card. An invoice will be drawn up by Viré Wine Cellars and sent to the customer at the invoicing address.
The wines remain the property of Viré Wine Cellars until the invoices have been paid in full.
When the order is paid for by the customer on the website, Viré Wine Cellars do not have access to information concerning the customer's bank account because the payment is made directly by the bank's electronic payment system, which is Société Générale's Sogenactif
The payment is carried out in full when the order is placed using a credit card (Carte Bleue, Visa or Euro card). The purchase is debited immediately.
If a payment is refused, the customer must contact his/her bank to check whether there is any problem with his/her bank accounts. Viré Wine Cellars cannot be held liable in any way for this type of situation.
Our products remain our property until their price has been paid in full.
V. Delivery
The wines are delivered in cartons of 1, 2, 3, 6 or 12 bottles, to be delivered in one consignment to the same address.

Viré Wine Cellars undertake to make every effort to deliver the products ordered as quickly as possible.
The delivery is carried out within the deadline, by the products being handed over directly to the named recipient, or in case of absence, by the recipient being notified of the product's arrival by a calling card.
Possible delays, except in the case of force majeure, may entitle the customer, upon request, to be refunded. The following are considered as cases of force majeure, freeing the seller from the obligation to deliver: war, rioting, fire, strikes, accidents or the impossibility of disposing of supplies.
Always check your delivery upon its arrival. You have 48 hours to express possible reservations to the transporter should products be missing or damaged. This procedure is absolutely essential for complaints to be taken into account.
VI. Possibility of returning goods
In accordance with Article L. 121-20 of French consumer legislation, the buyer benefits from a period of 7 full days, attested by the date of delivery, within which to retract and to send back the goods without incurring any penalty other than the cost of return transport. Goods should be returned to the address of Viré Wine Cellars in the same condition as that in which they were delivered. Before returning any goods, the customer must contact the Customer Department of Viré Wine Cellars. The buyer assumes liability for the return of the goods and the cost thereof.
Viré Wine Cellars undertakes to refund to the consumer the total amount paid, as soon as possible and at the latest within 30 days following the retraction date.
VII. Personal information
In accordance with Article 27 of Law n° 78-17 of the "Data-processing and individual freedom" Act of January 6th, 1978, customers have the right to access, to modify, to rectify and to delete data concerning them. In order to exercise this right, customers must access their personal account and modify the information concerning them.

VIII. Protection of under-age persons
In accordance with Article L. 3342-1 of French public health legislation stipulating that the sale of alcohol to uner-16s is prohibited, buyers, when creating their account on the Viré Wine Cellars' website, recognise that they are over 16 at the time of their order.
IX. Copyright
In accordance with the clauses of French law n° 98-536 (July 1st, 1998), a transposition of the European directive 96/9/CE (March 11th, 1996) concerning the legal protection of databases, Viré Wine Cellars are the owners of the whole or part of the databses which compose the present site.
All the data featured on this site (texts, images, graphics, logos, icons) are protected by copyright and may on no account be used in any form of document outside Viré Wine Cellars without their specific agreement

XI. Liability and applicable jurisdiction
Viré Wine Cellars are exempt from any liability in the case of circumstances beyond the control of its representatives, even if they cannot be considered as cases of force majeure. Viré Wine Cellars remind you that the abuse of alcohol is dangerous for your health and that they cannot be held responsible for the consequences of its consumption.
The present general sales conditions are subject to the application of French law.
The legally binding information is presented in French and the products on sale comply with French legislation.
In the case of a dispute, the customer should refer in the first instance to the Customer Department of Viré Wine Cellars in order to reach an out-of-court solution.
Should the negotiations fail, the court of Viré Wine Cellars' head office will be solely competent for any dispute resulting from the application of the present general sales conditions, without excluding the possibility for Viré Wine Cellars to refer it to another competent court.
